Terms and conditions

Updated 25.10.2026

This English version is a translation provided for information. In case of any discrepancy, the German version is authoritative.

1. Scope

These general terms and conditions (terms) apply to all services that Christian Ördög provides under the name ‘chrismachts’ (hereinafter ‘chrismachts’) to clients (hereinafter ‘the client’), in particular consulting, marketing, design, websites, shops, platforms, automation, AI and support.

The accepted quote takes precedence, followed by these terms and then the law. Any deviating terms of the client apply only if chrismachts agrees to them in writing.

The services are aimed at businesses, organisations and self-employed persons. Mandatory provisions protecting consumers in their country of residence remain reserved.

2. Free services

The initial call, advice given during the call, the business model check and the website check are free of charge and without obligation. They create no obligation to place an order. Assessments and recommendations from these services are based on the information provided by the client and on an initial review; they do not replace an in-depth analysis.

3. Prices on the website

No services are purchased or paid for on the website. Prices and price ranges shown there are indicative prices for guidance and not a binding offer. The fixed price is set in the written quote (section 4). Christian Ördög is not subject to Swiss VAT; no VAT is charged on his services.

4. Quote and conclusion of contract

Only the written quote, setting out the scope of services and a fixed price, is binding. It is valid for 30 days. The contract is concluded when the client accepts the quote in writing within this period; confirmation by email is sufficient.

The fixed price covers all services described in the quote. Anything not in the quote costs nothing extra: additional costs arise only if chrismachts announces them in advance and the client agrees (section 5).

Third-party fees, for example for domains, hosting, licences or advertising budgets, are paid by the client directly to the respective provider unless the quote provides otherwise.

5. Approvals and change requests

An approval is the client’s confirmation that a draft or interim version can be implemented as it stands; an email is sufficient.

For change requests made after an approval and for additional services not included in the quote, chrismachts announces the expected effort before carrying them out. Once the client agrees, they are charged at the hourly rate stated in the quote or on the basis of a new quote.

6. Drafts

If the first draft is not convincing, chrismachts prepares further drafts within the scope of the quote. Approval of a draft sets the design direction.

7. Client’s cooperation

The client provides the necessary content such as texts, images and logos, as well as the necessary access and information, in good time, and gives feedback and approvals within the agreed deadlines. Delays caused by a lack of cooperation postpone agreed dates accordingly. If this causes additional effort, chrismachts announces it in advance.

The client ensures that it holds the rights to the content it supplies and that its use does not infringe any third-party rights. The client is responsible for the lawfulness of the content published on its website, in its shop or in its campaigns. Where chrismachts prepares legal texts such as a legal notice or privacy policy as a template, these do not replace legal advice.

8. Acceptance and defects

On completion, the client reviews the work and reports any deviations from the quote in writing within a reasonable period. The work is deemed accepted when the client expressly accepts it or puts it live. The client reports defects discovered later immediately after discovering them. chrismachts remedies deviations from the quote free of charge within a reasonable period.

9. Payment

Unless the quote provides otherwise, chrismachts invoices 50% of the fixed price when the order is placed and 50% at go-live, or on acceptance for services without a go-live. Invoices are payable within 30 days net.

Support plans and services charged by time are invoiced as set out in the quote. In the event of late payment, the statutory provisions apply.

10. Support plans

Support plans run monthly and have no minimum term. Either party may terminate them in writing at any time with effect from the end of the following month; an email is sufficient. Example: if notice is given in March, the plan ends on 30 April.

On termination, chrismachts hands over the access and data the client needs to continue operating.

11. Rights to work results

On full payment, all transferable rights to the work results created specifically for the client, in particular code, design and content, pass to the client. This includes the right to use, modify, further develop and pass on the results without limitation in time or territory. Until full payment, the client may use the results for the agreed purpose.

Domains as well as hosting and third-party accounts are registered in the client’s name. Third-party licences, for example for fonts, plug-ins, software or images, are subject to the terms of the respective rights holders.

chrismachts may continue to use its general know-how, methods and pre-existing components that were not created specifically for the client. Where these are contained in the work results, the client receives a perpetual, non-exclusive right to use them.

12. Partners and subcontractors

chrismachts may involve partners and subcontractors for individual services. chrismachts remains the client’s sole contractual partner and responsible for their work.

13. Confidentiality

chrismachts treats all non-public information of the client as confidential, including after the end of the collaboration. All partners and subcontractors involved are likewise bound by confidentiality.

14. Data protection when processing on the client’s behalf

Where chrismachts processes personal data on behalf of the client in the course of an engagement, for example customer data from a website or shop, the client is the controller and chrismachts the processor. chrismachts processes this data only for the agreed purpose and in accordance with the client’s instructions, treats it as confidential and protects it with appropriate security measures. chrismachts involves partners and subcontractors who process personal data in this context only with the client’s prior consent. Where the GDPR applies or the client so requests, the parties conclude a separate data processing agreement.

The processing of personal data by chrismachts as controller is governed by the privacy policy on chrismachts.ch.

15. No guarantee of results

chrismachts performs its services with care and in line with current good practice. chrismachts cannot guarantee specific revenue, enquiries, rankings in search engines or AI answers, or results of advertising campaigns. These depend on factors that chrismachts cannot influence, such as the market, competition and the rules of search engines and advertising platforms. Results of earlier projects are no promise for future projects.

16. Liability

To the extent permitted by law, the liability of chrismachts is limited to wilful intent and gross negligence. Liability for slight negligence is excluded. chrismachts is not liable for outages or changes of third-party services that the client uses in its own name, such as hosting, payment providers or platforms.

17. References

chrismachts names the client or a project as a reference, for example on the website or in presentations, only with the client’s consent.

18. Changes to these terms

chrismachts may amend these terms. Each engagement is governed by the version in force when the quote was accepted. chrismachts announces changes affecting running support plans at least one month in advance; if the client does not agree, it may terminate the plan with effect from the date the change takes effect.

19. Final provisions

Amendments and additions to a contract must be made in writing; an email is sufficient. If any provision of these terms is invalid, the remaining provisions remain valid. The invalid provision is replaced by a provision that comes as close as possible to its purpose.

These terms are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (Vienna Convention). The place of jurisdiction is Rebstein SG, the place of residence of Christian Ördög, unless the law provides for another mandatory place of jurisdiction.
